nivas terms of service, in plain English

These terms apply to anyone who installs the nivas extension, visits nivas.aiagentslive.com, creates an account, joins a plan or buys one (together, the Service). The Service is run by AI Agents Live from Toronto, Ontario, Canada (we, us and our).

By using the Service you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the Service.

nivas helps you keep track of rentals that you find on Kijiji: you save listings, give them a status, write notes, pin comments on photos and check the commute. It works in your browser, and the free version keeps everything on your computer.

nivas does not sell, list or rent anything, and we are not a party to any rental. What a listing says, and whether it is true, is up to its poster and to you. Check every listing yourself before you pay or sign anything.

You need an account to buy or join a plan. You must be at least 16 years old, and old enough in your country to enter a contract. You sign in with a code sent to your email address, so you are responsible for that mailbox and for what happens under your account.

A person can belong to one plan at a time.

A plan costs CA$20 once and lasts 2 years. It includes 2 people. Each extra person costs CA$5, paid once, and lasts until the plan ends. Prices are in Canadian dollars and are shown before you pay. A plan does not renew by itself and is not a subscription. When a plan has ended, its owner can buy it again.

Payments are processed by Stripe. We never see or store your full card number. A plan or seat only starts after Stripe confirms the payment to us, which can take longer for some bank payments.

If we charge you by mistake, or we cannot give you what you paid for, tell us and we will refund you.

The person who buys a plan is its owner. The owner can invite people with a link or by email, up to the number of seats, and can remove members. Anyone can leave a plan.

Every member can read and change the shared listings, and reads all the notes and photo comments, which are shown with the writer's short name. Each member changes only their own notes and comments. Only invite people you are happy to share your hunt with.

If the owner leaves, the plan ends for everyone on it at once. When a plan ends or runs out, sharing stops. Everyone keeps their local copy and the free extension keeps working. We keep the plan's shared data for 90 days, so that buying again restores sharing, and then we delete it.

Your content is the listings, notes, photo comments and anything else you save with nivas. You keep ownership of it. When you turn sharing on, you give us the right to store it and show it to the members of your plan, and only for running the Service. This right ends when your content is deleted from our server.

We own the Service, including its design, code, name and logo. Kijiji and Google, and their names and marks, belong to their owners.

You agree not to misuse the Service. In particular, you agree to the following.

• Do not use nivas to break the rules of Kijiji or the law, or to collect other people's personal data.
• Do not upload malware, or try to break, probe or overload the Service.
• Do not share an account, or use automated tools to call our server, other than the nivas extension.
• Do not write anything illegal, hateful or harassing in your notes.

nivas is not affiliated with, endorsed by or sponsored by Kijiji or Google. Kijiji is a trademark of its owner. nivas works by reading pages that you open in your own browser, so a change to Kijiji's website can stop part of nivas from working. We do our best to keep up, and we do not promise that nivas will keep working with any website.

You can stop using nivas at any time by removing the extension. To close your account or delete your data, write to us and we will take care of it.

We may suspend or close an account if you break these terms or abuse the Service. When we can, we tell you why. Sections that by their nature should continue, such as ownership, liability and governing law, still apply afterwards.

We work to keep the Service accurate and available, but we provide it as is and as available. We do not promise that it will be uninterrupted or free of errors, or that sharing will always keep up within seconds. Keep your own backup: the extension can export your hunt.

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for lost data, profits or goodwill, or for a rental that you did or did not get. Our total liability for any claim about the Service is limited to the greater of the amount you paid us in the 12 months before the claim and 100 Canadian dollars. Nothing in these terms limits any right you have under the law that cannot be limited.

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict of law rules. The courts of Toronto, Ontario have exclusive jurisdiction over any dispute, except where your local consumer law lets you bring a claim where you live.

We may update these terms from time to time. The date at the top of this page shows when they last changed. When a change is significant, we will tell signed-in people by email before it starts.

Using the Service after a change means you accept the updated terms. If you do not accept them, stop using the Service.
